By installing or using the GeoVeris Android application ("the App"), you agree to these Terms of Service ("Terms"). If you don't agree, please uninstall the App.
GeoVeris is a mobile application that visualizes publicly available geological and oil & gas data on an interactive 3D globe. Specifically:
The App is provided as a tool for educational, research, and informational purposes. It is not a survey instrument, a regulatory record of authority, a legal record of property rights, or a substitute for professional advice.
Subject to these Terms, Epoch11 grants you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Android devices you own or control, for your personal, non-commercial use, or for internal use within your organization.
You may not: - Reverse-engineer, decompile, or disassemble the App, except to the extent that such restriction is prohibited by applicable law. - Strip or alter the attribution credits required by the underlying data licenses (see LICENSES). - Use the App or its bundled data to operate a competing data service, mirror, or API. - Use the App in violation of any applicable law.
Well locations, statuses, and attributes are aggregated from public regulatory datasets ("Source Data"). Each record is captured from its public source on a specific date and is not updated in real time. Authoritative information always lives at the originating regulator. The App displays the regulator's name and a source URL on every well's detail panel — when in doubt, follow that link.
Source Data is messy. Coordinate precision varies; status changes lag; older wells may have been re-permitted, plugged, or re-classified after the snapshot was taken. Do not rely on the App to:
Surface geology polygons (USGS SGMC, Macrostrat) and fault traces (GEM) are research-grade compilations. They are interpretations, not measurements. The App is not a substitute for site-specific geological investigation by a licensed geoscientist.
Nothing in the App constitutes engineering, geological, legal, financial, or environmental advice. If you need a decision made on the basis of subsurface conditions, hire a licensed professional in the relevant jurisdiction.
THE APP AND ALL DATA IT DISPLAYS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR UNINTERRUPTED OPERATION. EPOCH11 DOES NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR THAT THE DATA IT DISPLAYS IS ACCURATE OR CURRENT.
Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the above exclusions apply to the maximum extent permitted by law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL EPOCH11, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF — OR INABILITY TO USE — THE APP OR THE DATA IT DISPLAYS, EVEN IF EPOCH11 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
EPOCH11'S AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.
You agree to defend, indemnify, and hold harmless Epoch11 and its officers, directors, employees, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your misuse of the App, (b) your violation of these Terms, or (c) your violation of any law or third-party right in connection with your use of the App.
The App bundles or streams data licensed from third parties. Your use of the App is also subject to the terms of those licenses, which are reproduced in LICENSES. In particular:
The App's "Credits" screen displays all required attributions. Do not remove or obscure that screen.
We may update the App, change features, or discontinue features without notice. Material changes will be reflected in the App's release notes. We may also update the bundled data over time; older bundles will continue to function but will become out-of-date.
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Material changes will trigger an in-app notice on next launch. Continued use after a material change constitutes acceptance.
These Terms remain in effect until terminated. You may terminate at any time by uninstalling the App. We may terminate your license if you breach these Terms. The disclaimers, limitations of liability, and indemnification obligations survive termination.
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-laws rules. The exclusive venue for any dispute arising out of or relating to these Terms or the App is the state or federal courts located in Summit County, Colorado, and you consent to personal jurisdiction in those courts.
If you are a consumer based outside the United States, mandatory consumer-protection laws of your country of residence may apply notwithstanding the above.
GeoVeris is built on open-source software. The licenses for those components are reproduced in LICENSES and accessible from the App's "About > Open-Source Licenses" screen.
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force. These Terms (together with the Privacy Policy and LICENSES) constitute the entire agreement between you and Epoch11 regarding the App.
